Hi everyone,

I just wanted to let you know that some of you will be receiving an email from Pump King’s customer service to advise that Pump King has been purchased by Horizon Fuel Limited and will now operate under Fuelpecker.

Fuelpecker has listened to customer feedback and developed set discounts off the pump price which means guaranteed savings and therefore no more weekly fuel price text messages or variable savings. Fuelpecker has also expanded the network to include Shell petrol stations. In addition, the Fuelpecker set discounts are now available in Europe so you can save whilst travelling.

Your Pump-King account will be cancelled and your information will be securely Deleted User from Pump-King on the 17th February 2020. Therefore your Pump-King card will not work after the 17th February 2020.

In reinforcement of the point I made above about Pump Kings past and future processing of "our" data" their terms and conditions state :-

"Moreover, we can disclose your personal data to third parties:
●  If we sell or buy any business or assets, in which case we can disclose your personal data to the prospective seller or buyer of such business or assets;
 If Pump-King, its business, or its assets are acquired by a third party, in which case personal data held by it about its users, suppliers, or customers will be one of the transferred assets; and
●  If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms and conditions and other agreements; or if we reasonably consider this necessary; or to protect the rights, property, or safety of Pump-King, our users, our customers, or others."

The conditions are not well drafted but are very wide, allowing data sharing with prospective as well as actual acquirers of the business both before and after a sale.

Presumably however the Club have obtained a specific undertaking about data destruction in 10 days time (as opposed to for example just regurgitating a Company Statement or press release) because they have made a clear and unambiguous statement above :-

"Your Pump-King account will be cancelled and your information will be securely Deleted User from Pump-King on the 17th February 2020".

BTW isn't the Fuelpecker website "illegal" as it does not have any contact information etc.  The only way to contact is via email?  There is not even an address on the website? 

I registered yesterday and today decided to have another read of the T&Cs on the Fuelpecker site and they are nowhere to be found.  Not even hint?  Surely that is not correct and could be illegal according to current legislation?

Seems the club has chosen another fly by night outfit to give us discounts.  BTW no mention of how they will process VAT payments?

Thats the address of the Registered Office. It seems to be a professional office/company registration business or whatever. There is nothing illegal about using that of course but it is unlikely to be the place of operation of the business. 

As already commented upon the terms and conditions seem to be the same as "Pump King" . The absence of a place of business (as opposed to a registered office" and the inability to phone are factors which merit consideration.

Nice new office block. Facade is the old central electric lighting station. Provided the first electricity to Bristol at the end of the 19th century.

As Pump King will, it seems,no longer exist after 17th Feb i would expect the data held by Pump King will be Deleted User,but the "company?" Fuelpecker that seems to have bought the assets,will have already have the Data , so they are not giving false information when stating "the data held by Pump King will be Deleted User on the 17 Feb"undecided

I can't see the issue.  CC Ltd is simply repeating that which was posted on the Pump King website and sent to their customers.  The data may have been past to the new company but legally they are unable to act upon it other than to give the customers of Pump King the opportunity to apply for a card with Fuelpecker.
